Photoshoots
9AM Media Ltd would be delighted to be involved on capturing your home ready for marketing or on a commercial assignment. 9AM Media Ltd Terms and Conditions are transparent as possible, there are no hidden extras. It is agreed that the following Terms and Conditions set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties.

Booking Fee 
9AM Media Ltd does not charge a booking fee for Real Estate Photography, however any commercial/bespoke assignments are looked at individually and may occur a small booking fee charge. 

Cancellations
If the client requests to cancel the photoshoot or fails to show for the arranged photographic event on the same day of the booking, all monies of the booked appointment/photoshoot, shall be forfeited to 9AM Media Ltd. Discretion will be used if this is due to severe illness or personal circumstances. Cancellations made 1 day before the booking, a fee of 50% of the cost of the appointment will be charged.

Usage Licenses
9AM Media Ltd may use any images included in this contract in their social media marketing, web site, portfolio, literature, display areas, exhibitions, competitions, advertising, slide shows or commercially unless the subjects express the wish for this not happen prior to the photoshoot.

Copyright 
Any images or copies of images whether stored digitally or otherwise, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988 and remain the copyright of 9AM Media Ltd. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the permission of 9AM Media Ltd.

License 
9AM Media Ltd will use judgment regarding the locations, angles and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.

Weather
9AM Media Ltd will make an assessment on the weather on the day of the appointment. If the photoshoot is deemed to be unsafe or impossible to capture due to the weather, 9AM Media Ltd reserves the right to reschedule the appointment. Drone footage can only be carried out in dry conditions. 

Attendance
In the unlikely event of 9AM Media Ltd being unable to attend your home or business premises due to unforeseen circumstances, we reserve the right to appoint another company to attend your appointment on our behalf to undertake the photography/media to his / her best ability.
When no suitable substitution can be found 9AM Media Ltd will reschedule the appointment and give priority booking to ensure a quick turnaround and delivery of the images/media.

Limitation of Liability
a. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
b. The Client shall maintain control of all subjects, including human beings and pets. It is the responsibility of the Client to ensure the cooperation of their pets and household during the photoshoot. The Client shall cooperate and follow the directions of the Photographer during the session. Failure to cooperate will result in termination of the session and forfeiture of retainer.
c. 9AM Media Ltd will not be held responsible for any repairs to the property that have not been highlighted before the photoshoot. This includes any interior, exterior, structural or covered up repairs. All care is taken on freshly laid carpets, door/cupboard openings and work surfaces during the photoshoot.
d. The supply of products/services are provided by 9AM Media Ltd on a reasonable endeavours basis and agreed deadlines met where possible. 9AM Media Ltd shall not be held liable for any delays in meeting any of our obligations which were due to cause beyond our reasonable control including but not limited to sickness, adverse weather conditions, acts of god, floods, fire or loss.

Archive & Storage
9AM Media Ltd shall ensure all digital images and media are kept safe for up to 12 months (1 year) after the photoshoot. No responsibility shall be taken by 9AM Media Ltd after the images/media have been delivered to the client. It is the responsibility of the client to ensure that the images/media are kept safe and secure on their systems after delivery.
